General Terms and Conditions for Manhattan88Mobil Inc. 

 

I N T R O D U C T I O N 

These Terms and Conditions ("Terms") govern your use of services provided by Manhattan88Mobil Limousine Service Inc. ("we," "us," or "our"), including luxury transportation, chauffeur services, and exotic limo service with chauffeur. By booking with us, you agree to these Terms.

1. Booking and Reservations

  • Advance Booking: To ensure availability, clients are encouraged to book as early as possible, particularly for special events, peak times, and exotic limo service with  chauffeur.
  • Reservation Confirmation: Reservations are confirmed only upon receipt of a booking confirmation from our team. Rates are subject to change until confirmation is provided.
  • Special Requests: Any special vehicle requests or additional requirements should be made at the time of booking. We will try to accommodate requests, but availability is not guaranteed.

2. Payment Terms

  • Deposit: A deposit may be required for certain reservations, particularly for specialty vehicles or exotic services. Deposit requirements will be specified in the booking confirmation.
  • Payment Methods: We accept major credit cards, debit cards, and electronic payments. Payment details are securely processed through trusted third-party providers.
  • Final Payment: Full payment is due before the commencement of service unless other arrangements have been made for corporate or recurring clients.

3. Cancellation and Refund Policy

  • Standard Reservations: Cancellations for standard bookings must be made at least 24 hours in advance for a full refund. Cancellations made within 24 hours are subject to a cancellation fee.
  • Specialty and Exotic Vehicles: Cancellations for exotic or specialty vehicle rentals require a minimum 48-hour notice. If cancellation occurs within 48 hours, a portion of the rental fee may be non-refundable.
  • No-Show Policy: In the event of a no-show, the full reservation fee is non-refundable.

4. Client Responsibilities

  • Personal Belongings: We are not responsible for lost or stolen items left in vehicles. Clients are advised to check for all personal belongings before leaving the vehicle.
  • Conduct: Clients are expected to conduct themselves respectfully towards our drivers and follow vehicle safety rules. Manhattan88Mobil reserves the right to refuse service to any client engaging in unsafe, disruptive, or abusive behavior.
  • Damage to Vehicles: Any damage caused to the vehicle due to negligence or misconduct by the client or their guests may result in additional charges.

5. Chauffeur and Service Policies

  • Professional Chauffeurs: All chauffeurs are carefully selected, trained, and background-checked. We expect our clients to treat chauffeurs with respect and refrain from requesting any actions that violate traffic laws or company policies.
  • Delays and Waiting Time: We aim to be on time for all pick-ups. However, unforeseen delays may occasionally occur. For waiting times beyond 15 minutes, additional charges may apply.
  • Flight Monitoring: For airport pickups, we monitor flight statuses to accommodate early or delayed arrivals. However, we cannot be held responsible for extreme delays or unexpected flight cancellations.

6. Liability and Insurance

  • Insurance Coverage: All vehicles are insured according to local and state regulations. However, Manhattan88Mobil is not liable for any accidents, injuries, or damages that occur due to factors beyond our control, including weather conditions, traffic delays, or unforeseen events.
  • Client Safety: We prioritize safety and will not be liable for injuries due to client negligence, such as failure to wear seat belts or improper conduct in the vehicle.

7. Force Majeure

We are not liable for any service cancellations or delays caused by events beyond our reasonable control, including natural disasters, severe weather, strikes, road closures, or other unforeseen circumstances.

8. Privacy Policy

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we handle your personal data.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on our website, and continued use of our services constitutes acceptance of the revised Terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of New York, and any disputes shall be subject to the exclusive jurisdiction of courts in New York County.

1.1. These general terms and conditions for the “Manhattan88Mobil Inc.” proposition (hereinafter the “General Terms and Conditions”) have been issued by Manhattan88Mobil Inc., which has its registered office in:

Manhattan, NY.10017 USA and is registered on Manhattan88Mobil Inc and EIN Companies Registry under No. 84-2643557 represented by its Deputy CEO, JD.Margono (hereinafter “Manhattan88Mobil Inc”).

1.2. These General Terms and Conditions will be agreed by Manhattan88Mobil Inc. and any private individual who is an adult, and wishes to enjoy access to, and the use of the services and products provided via the website: www.manhattan88mobil.us, to the related website and to the application, as well as to the other content, websites, applications, products and services (hereinafter jointly referred to as the “Platform”) made available by Manhattan88Mobil Inc. as part of its [“Driver Services”] proposition

1.3. Manhattan88Mobil Inc. reserves the option to amend or supplement these General Terms and Conditions at any time, with no retroactive effect. These potential amendments will be forwarded to you, and will become an integral part of the agreement once you have accepted them. The forwarding of the New these General Terms and Conditions by Manhattan88Mobil Inc. to the contact email provided will be sufficient to assume that you agree to them. Unless any objections to the amendments made to the General Terms and Conditions are raised by you within a period of one (1) month, you will be deemed to have agreed to them. When it forwards you the new General Terms and Conditions, Manhattan88Mobil Inc. will inform you of the means available to you for expressing your perusal, and also to the concept of the expiry of the one (1) month timeframe.

2.  OBJECT AND SCOPE OF APPLICATION OF THESE TERMS AND CONDITIONS
2.1. These General Terms and Conditions regulate the access to or use by you (the “Users” or “you”) of the Platform provided by Manhattan88Mobil Inc. They apply to the brokerage, via the Platform, by telephone or via email, of service agreements for chauffeur and transport services arranged with the partners and service providers who are engaging in the “Manhattan88Mobil Inc.” proposition (hereinafter the “Service Agreements”).

2.2. Via the Platform, Manhattan88Mobil Inc. enables Users to subscribe to the services offered by service providers (such as chauffeurs, or companies offering their chauffeur-driven car services), and to perform these Service Agreements. This means that Manhattan88Mobil Inc. is involved solely in the capacity of an intermediary or broker, and does not itself provide the chauffeur-driven car services. By using the Platform, you acknowledge that (i) Manhattan88Mobil Inc. is not itself providing the chauffeur-driven car services, and (ii) you have no rights to broker or enter into Service Agreements.

2.3. Considering that the chauffeur-driven car service proposition available on the Platform is organized by the service providers, each trip that you book will be governed by the general terms and conditions of transport specific to the service provider in question (the “Carrier’s Terms and Conditions”). In that regard, you also acknowledge that you have rights solely in relation to the service provider who is providing said services.

3.  REGISTRATION AND USE OF THE PLATFORM
In order to be able to access and enjoy the services offered on the Platform, you must create an account subject to the conditions set out below.
3.1. General Principles
To use the Platform, you must complete the registration process, the steps of which are set out below. Registration is Free, Non-Exclusive, and Non-Assignable. It also implies your acceptance of these General Terms and Conditions.

3.2. Steps to Follow In Order To Register
a)  You must fill in an online registration form in which you (i) provide data enabling you to be identified (see below), and (ii) choose your password and your user ID;
b)  You must check and approve this form, and confirm your acceptance of the General Terms and Conditions;
c)  Once you have completed this step, an email confirming the registration will be sent to you, and you will therefore be able to gain access to the Platform. Notwithstanding this, Manhattan88Mobil Inc. reserves the right at any time-to accept or refuse your registration.

3.3. Information Regarding User’s Identity
When you register, you must enter your contact details, a user ID, and a strictly private password:

  1. You must enter your title, surnames, first names, and email address, as well as your cellular telephone number; and
  2. Guarantee that the data disclosed is accurate, complete, and up-to-date. You are required to keep your password secret. You are prohibited from allowing third parties to use your account. If you suspect or are aware that a third party has used your account or User ID, you must inform Manhattan88Mobil Inc. directly. Manhattan88Mobil Inc. will then be entitled to block your account until the problem is resolved.

3.4. Communication
You agree that statements required or simply useful for ensuring the proper operation of the Platform and the services provided may be forwarded to you at the email appearing in your number’s account.

3.5. Non-Applicability Of The User’s General Terms and Conditions
by registering on the Platform, you acknowledge that any general terms and conditions specific to you will not apply under any circumstances, even if Manhattan88Mobil Inc. does not expressly object thereto.

3.6. Cancellation
Your registration and acceptance of the General Terms and Conditions will be valid indefinitely. You may nonetheless cancel your registration at any time and with no notice in a written statement addresses to Manhattan88Mobil Inc., or by sending an email to: [marketing@garuadua.com], from the email address appearing in your member’s account. Manhattan88Mobil Inc., may also cancel your registration on the Platform at any time and with no notice via an email sent the address appearing in your member’s account.

4.  ENTERING INTO SERVICE AGREEMENTS
Process
The Service Agreements between you and the service providers will be entered into via the Platform as follows: you specify the desired service (e.g. details of the trip, reservation time, etc.), and fill in the reservation form. The service rate will be displayed on the Platform depending on the various categories of services offered. You choose the package, the desire rate, and your contact details, as well as your preferred payment method. Before confirming any final reservation, you may check and correct the data entered in your request for the service.

When you make a reservation request via the Platform, you issue a request to enter into a Service Agreement with a service provider. You will receive a confirmation email acknowledging receipt of your request as soon as it is received. The Service Agreement will permanently be entered into by you and the service provider from the time when you receive, immediately prior to the journey, a separate statement (“Reservation Confirmation”) including the company name and contact details of the service provider selected. The Carrier’s Terms and Conditions will be fully applicable to you in addition to these General Terms and Conditions. They will be made available to you prior to the final confirmation of your request.

5.  CANCELLATION OF SERVICE AGREEMENTS
You may cancel the Service Agreements entered into free of charge or in exchange for certain charges, depending on the Carrier’s Terms and Conditions. The Carrier’s Terms and Conditions are available on the Platform.

6.  PAYMENT AND SETTLEMENT OF EXPENSES
6.1. Payment Method
The price and the available means of payment are specified on your screen during the reservation process. The sum agreed in the Service Agreements includes any possible expenses and, where applicable, tax levies. The amount of expenses agreed in order to reserve a trip is valid for the agreed trip, with no stops or detours. In the event that you reserve by the hour, you will still be liable for the amount agreed, even if you decide to shorten or interrupt the trip. 

6.2. Invoices
Once a reservation has been made, Manhattan88Mobil Inc. will send you, exclusively on behalf of the service provider, an invoice via email setting out the amounts payable and/or paid.

7.  PROMOTIONAL CODES
Manhattan88Mobil Inc. or, where applicable, its service providers, may, at their complete discretion, create promotional codes which may be used to obtain an account credit on the Platform, or other functions or similar benefits. You agree that these promotional codes (i) must be legally used by the audience for which they are intended and for the purposes intended, (ii) may not be duplicated, sold, or transferred in any way, (iii) may be deactivated at any time by Manhattan88Mobil Inc. and for whatever reason, and (iv) may expire before they are used. Manhattan88Mobil Inc. reserves the right to decline or reduce the related credits or other benefits in the events that Manhattan88Mobil Inc. takes the view or considers that benefits or credits were used erroneously, fraudulently, illegally, or contrary to the above terms and conditions.

8.  Manhattan Dial USA AND THE SERVICE PROVIDER’S LIABILITY
Manhattan88Mobil,Inc. is liable to you solely for the obligations arising from the use of the Platform. Manhattan88Mobil Inc. will not under any circumstances be liable for the actions or omissions committed by the service providers, particularly when this concerns the signing or performance of the Service Agreement. The service providers, the drivers employed by the service providers or the sub-contractors appointed by the service providers are neither employees nor sub-contractors of Manhattan88Mobil Inc.

Manhattan88Mobil Inc. will not under any circumstances be liable for the service provider’s compliance with the applicable legal or regulatory provisions incumbent upon the latter. Furthermore, Manhattan88Mobil Inc. will exempt itself from any liability relating to the accuracy, reliability, comprehensiveness, and up-to-date nature of the content and programs made available Free of Charge via the Platform, as well as from any loss that may result therefrom.

Manhattan88Mobil Inc. reserves the right to interrupt access to the Platform and to the provision of all or part of the content available via this at any time and with no notice for technical, security, or maintenance reasons, power cuts or any other valid reason. Manhattan88Mobil Inc. does not guarantee the long-term availability or performance of the services available on the Platform. You use the Platform at your own risk. The Platform is provided as is, and according to availability. Neither Manhattan88Mobil Inc. (nor any of its related entities) gives a guarantee, or makes a declaration that:
-   The Platform will meet your requirements;

  • The Platform will operate with no interruptions, in a secure manner, and will be free from errors, bugs, or other defects;
  • The results that could be obtained by using the Platform will be completely accurate or reliable; and
  • The quality of the services, information, or other content obtained via the Platform will meet your expectations and any error and/or glitch will be corrected.

Every User will of course be exclusively liable for their IT equipment, data and software, as well as for the connection to the network enabling them to gain access to the Platform. Similarly, Manhattan88Mobil Inc. can not be held liable for any damage to hardware, software, or data (e.g. contamination by a virus) suffered by the User due to their use of the services, or for any other damage caused to the User.

9.  PROTECTION OF PERSONAL DATA
9.1. Manhattan88Mobil Inc. and the service providers gather and record the personal data required for carrying out the operations. Any processing of this data by the latter complies with the legal requirements. 9.2. Please also note that any personal information gathered is essential for recontacting the User and/or creating User’s IDs. Otherwise, the request (s) can not be processed. The personal information gathered is intended forManhattan88Mobil Inc. and its chauffeur-driven car service providers, as well as for the members of the Manhattan88Mobil Inc. network. This data will be stored in Manhattan88Mobil Inc. and its service provider’s IT system. In accordance with the provisions of the USA Data Protection Act, you have the right to access, correct, and delete personal information that concerns you. 10.  GENERAL INFORMATION
10.1. Partial Invalidity
If one or several provisions in these General Terms and Conditions are held to be invalid, or declared as such pursuant to a law, regulation, or a final judgment issued by a competent court, the other provisions will remain in full effect and retain their full scope. Manhattan88Mobil Inc. and the User will then agree to replace the void or invalid clause by a clause that will be as close as possible, in terms of its content to the clause, initially approved.

10.2. Non-Waiver
The fact that Manhattan88Mobil Inc. does not invoke any of the provisions provided for under these General terms and Conditions during a certain period of time can not be interpreted as a waiver of its right to invoke them in the future.

10.3. Assignability
These General terms and Conditions can not be assigned by a party without the express prior consent of the other party. Manhattan88Mobil Inc. will nonetheless be authorized to assign them, together with the related personal data files, in the event of the takeover by a third-party company of eitherManhattan88Mobil Inc., or one of its business divisions if those divisions include the operation of the Platform. It is also understood thatManhattan88Mobil Inc. may freely replace any company in the group to which it belongs, to which the User expressly agrees.

11.  APPLICABLE LAW AND ASSIGNMENT OF JURISDICTION
These General terms and Conditions are governed by the USA law. The New York Courts will have jurisdiction in the event of a dispute, notwithstanding multiple defendants or joinder of third parties, including interlocutory proceedings or on application.
